NEMC takes autonomy push to parliamentary committees

Dodoma. The National Environment Management Council (NEMC) has taken its long-running quest for greater autonomy to Parliament, seeking legal changes to transform it into the National Environment Management Authority (NEMA), with stronger powers to enforce environmental laws and facilitate investment.

The proposed transformation is intended to strengthen the institution’s legal framework as Tanzania seeks to address environmental degradation, improve regulatory efficiency and create economic opportunities from waste management.

The proposals were presented to Parliament’s Standing Committees on Constitution and Legal Affairs and Water and Environment in Dodoma on October 21, 2026.

NEMC Director General Immaculate Semesi said the reforms were intended to align the institution with Tanzania’s Development Vision 2050 while enabling it to support investment and sustainable economic growth.

She said the objective was to make the regulator an enabler of business rather than an obstacle to investors seeking to comply with environmental requirements.

“The aim is to make the institution a facilitator rather than an obstacle to investors, particularly in complying with legal requirements and obtaining the necessary permits,” Dr Semesi said.

The proposed changes include renaming NEMC as NEMA and strengthening the legal provisions governing its operations to enable it to carry out its responsibilities more effectively.

Dr Semesi said the reforms would help balance investment needs with environmental protection without compromising existing environmental laws.

For NEMC, the proposed transformation goes beyond a change of name. It raises the question of whether a stronger legal status will give the institution the authority and operational capacity needed to enforce environmental regulations more effectively.

Chairman of Parliament’s Standing Committee on Water and Environment Jackson Kiswaga said the government, through Parliament, had agreed to establish an environmental authority to strengthen NEMC’s legal powers.

He said continued environmental degradation across the country made stronger supervision and control of activities that threaten the environment necessary.

Mr Kiswaga also identified overlapping responsibilities in environmental management as a challenge to effective enforcement.

Under the Environmental Management Act, Chapter 191 of 2004, local government authorities have environmental management responsibilities. He said gaps in oversight had contributed to difficulties in implementing those responsibilities effectively.

The proposed authority is expected to strengthen environmental supervision nationwide. Its effectiveness, however, will depend on the powers granted under the new law and how its responsibilities are coordinated with those of local government authorities and other institutions.

NEMC also presented proposals on solid waste management to the parliamentary committees, highlighting opportunities to generate economic value through recycling and waste processing.

Dr Semesi said improved waste management was important for protecting public health and the environment, while treating waste as a resource that could create economic opportunities.

She said recycling and waste processing could provide raw materials for industries and support businesses involved in waste collection, sorting and recovery.

Turning this potential into commercial opportunities, she added, would require investment in infrastructure and effective waste collection systems.
